Charlotte has extensive experience of complex domestic and multijurisdictional trust disputes involving breach of trust, beneficiary rights of information and jurisdictional issues. Charlotte has particular experience of claims involving fraud and asset tracing and has represented both claimants and defendants in connection with freezing injunctions and disclosure orders. Charlotte frequently advises on succession issues including validity claims, capacity and construction issues as well as claims under the Inheritance (Provision for Family and Dependents) Act 1975.

Jennifer joined Michelmores from a leading private client firm in London. Her clients are frequently international, although she also looks after a number of UK families and landed estates.  She acts for individuals and their families in all aspects of structuring their private wealth, including advising in relation to succession issues and tax planning.  For the families she looks after, Jennifer provides a holistic service, liaising with other advisers and involving other disciplines, such as agricultural work for landed estate clients and corporate aspects for business owners.   

A significant part of Jennifer's practice is advising UK trustees and offshore corporate trustees in relation to their duties as trustees and providing UK tax advice.  Jennifer also has particular experience in advising clients who are non-UK domiciled in relation to pre-arrival planning and pre-deemed domicile planning.

Chris Moorcroft advises individuals and families on wealth planning and succession matters. This includes the use of estate planning vehicles such as companies, trusts and foundations to manage the passing of wealth and family businesses to younger generations, to protect wealth from unexpected events like death and incapacity, to protect wealth from adverse third parties and to manage complex cross-border tax problems involving multiple jurisdictions.

He advises on will planning and probate involving assets spread across jurisdictions, including the application of the EU Succession Regulation. Roberta Harvey joined Forsters as a Partner in January 2019, and was appointed Head of the Contentious Trust and Estate (CTE) group on 1 April 2020.

Roberta is a specialist contentious trusts and estates lawyer and has an excellent reputation among her peers in representing high net worth individuals, family offices, trustees, protectors, executors and beneficiaries in respect of such matters. Examples of the cases Roberta deals with are as follows: validity issues, breach of trust, removal applications, construction arguments, freezing injunctions, asset tracing and recovery and the full remit of estate disputes. Roberta’s supportive and constructive approach to litigation inspires confidence in her clients. Roberta fiercely defends her clients’ best interests, while always considering the wider and long-term implications for their personal, financial and commercial interests. Taking a creative approach, Roberta will explore alternatives to court such as mediation, but will take matters to trial when necessary. Mara is a partner in the private client and tax team.

She advises on a range of wealth planning matters affecting successful individuals, entrepreneurs and their families. This includes high net worth individuals in respect of their tax, trust and estate planning, whether they are either non-UK domiciled or non-UK resident, or both. She has acquired extensive experience in advising clients on the reorganization of foreign holding structures owning UK residential properties so as to minimise UK tax exposure.

She advises on pre-immigration remittance planning for new arrivals, ongoing tax and succession planning during UK tax residence as well as pre-deemed domiciled planning for long term resident individuals, involving amongst others, the establishment of excluded property trusts, treaty reliance in the context of international Wills and relocation advice.

Her advice often focuses on issues involving double taxation treaties which the UK has signed with several counterparts (both for income and capital gains tax purposes as well as inheritance and succession tax) and on the regularization of undeclared offshore tax liabilities, in the past via the Liechtenstein Disclosure Facility and, more recently, thorough the Worldwide Disclosure Facility.

Mara is a native Italian speaker and has an Italian law degree but re-trained and qualified as an English solicitor. Because of her background, she has experience of advising on the interaction between common law and continental European elements both in connection with trust structures and estate planning and routinely advises Italian and other Continental European clients on matters impacting their wills and succession planning in the UK. In particular, over the years, her practice has focused on advising clients on the UK tax implications of European style usufruct arrangements created over foreign assets as well as on European insurance bonds issued by insurance companies based in Continental Europe. This includes advising on the traps as well as on some of the planning opportunities these instruments/investment wrappers can provide from a UK tax perspective, including inheritance tax, capital gains tax, income tax and stamp duty land tax.
