FIRE Up For 2023: Hot Topics for the Year Ahead

Highlights

Chaired by Becky Baker of RPC, our panel of experts will discuss the hot topics for 2023 facing FIRE practitioners. In this 60 minute session, our panel will reflect on key developments in these areas during 2022, and what they expect to see in 2023.

Topics include:

  • Increase in insolvency claims and claims against directors: The current geo-political and economic landscape is likely to mean that insolvency claims will continue to rise. The panel will discuss some of the key rights and obligations for companies, directors, investors and creditors to be aware of in the lead up to and after an insolvency event.
  • Continued flow of crypto litigation: Given the volatility in cryptocurrency markets during 2022, there is likely to be a continued flow of claims arising out of fraudulent conduct and litigation arising out of insolvencies.
  • Further developments in the Quincecare duty: The Quincecare duty saw significant judicial attention in 2022, our panel will recap on what was seen last year, and what is expected for 2023.

I am ranked as a 'Rising Star' for Civil Fraud in the Legal 500, where I've been described by clients as a "really dynamic, skilful litigator" and "a superstar in the making" who is "dedicated to providing an excellent client service, obtaining great results against the odds".

I was recently the lead associate in the case of AA v The Family Officer Limited in which I acted for a high-net worth individual to recover monies following a €15 million push payment fraud. The case spanned multiple jurisdictions and utilised 'Persons Unknown' freezing injunctions in the English High Court as well as evidence of mobile phone triangulation and spoofed emails. This case was a rare example of a fraud claim succeeding at the summary judgment stage.

I have conducted a number of internal investigations for large multinational corporate bodies involving fraud, corruption and bribery. My investigation work often overlaps with claims for breach of confidence resulting from the theft and use of confidential business information.
