Valuations for divorce proceedings can be affected by external forces such as market volatility and geo-political upheaval. Covid, Brexit, the Russia-Ukraine war and the recent bank collapses are all examples of recent world events which have had a significant impact on how assets are valued in divorce proceedings.

In this session, our panel of experts will discuss key considerations for Divorce Lawyers when faced with valuations in turbulent times. Topics to be discussed include:

  • Distribution of fluctuating, high risk assets.
  • Accounting for unfavourable changes in exchange rates.
  • Acknowledging the possibility of passive growth and passive decline.
  • How deferred payment agreements can be affected by turbulence.
  • Valuation from the day of separation vs. the day the divorce is finalised.

Jenny has over 20 years’ experience in wealth management, starting her career in 1999 advising expatriates on offshore investment funds before moving into corporate account management. Jenny is passionate about building relationships and working with individuals and their families, which prompted a move into the private client space where she has dedicated her time to working with high net worth individuals, building her expertise and areas of specialism.

During this time Jenny has successfully gained Chartered status and became a Fellow of the Personal Finance Society, she is also a member of Resolution. Jenny specialises in helping clients going through significant life changing events with particular focus on supporting high net worth and ultra-high net worth individuals with US connections.

Jenny enjoys running, regularly entering 10km races and lives in the countryside with her two sons.

Jessica is an Executive Director in the Private Investment Office. She joined London & Capital in 2007 and has broad experience in advising private clients with wealth management and investment strategy.

Jessica is a firm believer in collaboration and believes that the client can often be best advised by all their advisors working closely together. She therefore has a strong network of professional contacts in the legal, tax and fiduciary professions.

She has been recognised as a PAM Top 40 under 40 Wealth Manager, included in the Spears 500 top advisors and is a CityWealth Power Women award winner. She has a Modern Languages degree from Durham University and speaks fluent French and Italian.

Kellie is the leader of the Valuations practice of PwC in the UK, and specialises in providing valuation advice and opinions in the contexts of disputes over the value of businesses, assets or shares, often culminating in litigation or arbitration. Kellie is a Fellow of the Institute of Chartered Accountants in Australia and a member of the Financial Services Institute of Australasia.

Kellie has been valuing businesses for 20 years, across all industry sectors. Kellie’s valuations experience is broad - she performs valuations for transaction advisory, financial reporting, taxation, restructurings and expert determinations across a range of industry sectors - however, a significant amount of her time involves working with legal teams and clients where expert evidence on valuation/damages is needed.

Kellie works extensively on matrimonial disputes, including both single joint expert and sole expert cases, in the High Court (she has been the expert in over 50 of such cases). During the course of her career, Kellie has also prepared expert reports addressing valuation issues in respect of breach of warranty, breach of contract, professional negligence, agency disputes and minority oppression matters. These reports have been presented before UK Courts and International Arbitration Tribunals and she has given expert testimony.

Rachel has over 20 years’ experience in family law.  She practises in all areas of family law with particular expertise in complex financial cases and disputes in relation to children.  Many of her cases have an international aspect, often with links to France and French speaking countries.  

Rachel advises people from all walks of life.  She understands the pressures of family breakdown and the divorce process and takes the utmost care of her clients. She is known for her empathetic and compassionate approach, at the same time as providing clear and pragmatic advice.

Rachel is recognised in the Spear’s Family Law Index 2023, as a Citywealth Leader in Family and Matrimonial, and in the Chambers UK, Chambers Ultra High Net Worth, and Legal 500 directories. The Legal 500 has commented that she is “highly experienced in all areas of family law”, a “superstar”, and that “she has the unique ability to look at the heart of a case and grasp exactly what a client needs to resolve it.” It praises her “exceptional client care skills” and says that “she identifies fundamental issues very quickly, has excellent judgment and a proactive and constructive approach to problem solving.” Testimony in Chambers UK describes her as “very knowledgeable” and comments that “Rachel was absolutely brilliant; incredibly clever and considerate, thoughtful, and worked through every detail to ensure the best possible outcome, whilst always remaining honest and practical throughout."

Rachel is a collaboratively trained lawyer and a member of Resolution’s Drafting Committee.  She has given seminars on family law and writes for the legal press, and her comments on family law issues have been quoted in the Times and the Daily Mail.
