Highlights
The class actions landscape is undergoing rapid change and digital markets are likely to be the next battleground for enforcement through collective actions. Recent developments have included the introduction of the Digital Markets Act and the Digital Services Act in the EU; the launch of a slew of investigations and complaints against digital platforms in the EU and UK and the recent filing of parallel private enforcement actions.
During the 2nd episode in the series of class actions events, global panel of seasoned subject matter experts featuring counsel, economics and damages professionals will debate the different types of consumer harms which can arise in digital markets; the implications of new EU Acts and the options for private enforcement actions and their potential prospects.
Topics for discussion include:
- What types of harms can arise in digital markets?
- What are the particular challenges of bringing class actions in relation to these harms? What causes of action are there and what certification issues arise?
- What should be the role of private enforcement? Are actions helpful ahead of findings from regulators?
- What types of expert evidence are needed?
- What issues arise in quantifying the damages?
- What is on the horizon for the next wave of class actions in digital markets?
