Highlights
The production and use of evidence in international arbitration tends to be governed by a flexible matrix of institutional and ad hoc rules and "soft law", selected by the parties and tribunal. The tribunal will oversee the production, use and management of evidence using those resources. But parties' legal backgrounds from common law and civil law traditions, and their expectations, may have to be managed and compromise sought.
In this seminar the Panel will be looking at how these different factors affect the preparation and use of evidence in an international arbitration, with a view to highlighting specific issues that may need to be considered at the outset of the arbitration and commenting on the resources available to parties to assist in completion of this important stage.

David Parratt KC (Scot) is a busy barrister, advocate and arbitrator. David has extensive court experience and regularly negotiates settlements in multi-million pounds claims. He is often involved in complex international commercial disputes.
David’s practice covers his key experience and interests in arbitration, construction & engineering claims, energy disputes (including oil/gas upstream claims), general commercial litigation and commercial contracts.
He is a practising barrister in England & Wales and was called in 2009 (Lincoln’s Inn). He is an non-practising member of the Faculty of Advocates (Scottish Bar), having practiced from 1999 to 2020 - taking Silk in Scotland in 2017. He is also a non-practising member of the Northern Irish Bar, calling in 2016.

Jared is an experienced commercial litigator whose practice at Brodies encompasses a wide range of commercial and corporate disputes before the English Courts and in International Arbitration.
