Highlights
Richard Gwynne, partner at Stephenson Harwood, is one of the leading experts on jurisdiction and enforcement. Earlier this year he published two articles: "Enforcement of EU judgments post Brexit: an exclusivity conundrum" and "Brexit and dispute resolution issues".
During this interactive session, chaired by Donna Newman, Partner at Stephenson Harwood, Richard Gwynne will provide a short summary of where we are now on jurisdiction clauses and arbitration clauses in a post Brexit world. We will then look at a series of short scenarios which illustrate the key issues that parties are likely to encounter and Richard will provide expert analysis on (1) what issues arise and why; and (2) how the dispute clause or jurisdiction clause could have prevented these issues arising. Richard will be joined by Laura John QC of Fountain Court Chambers.
Points to cover:
- Where are we now with jurisdiction (post Brexit)?
- Potential pitfalls and how they can be avoided
- The risk of an Italian torpedo
- What is the current position on enforcement of judgments?
- How to minimise the risks with an effective dispute resolution or jurisdiction clause
- What advice should we be giving to clients?
