UK Witnesses in International Arbitration: Are They at a Disadvantage?

Highlights

In international arbitration, where the two sides are from different jurisdictions, witness preparation can consist of two very different approaches.

In the UK, the Bar Standards Board (BSB) guidelines, prohibit witness preparation beyond familiarisation with the hearing process and participants' roles – this can also involve cross-examination practice, providing the material is completely unrelated to the case. Conversely, in the US, more extensive witness preparation, such as, rehearsing answers to expected questions with the witness, is common practice.

In this one-hour free webinar, join New-York based founding partner of Dunning Rievman & MacDonald, Josh Rievman, Bond Solon professional trainer, Paul Gilbert, 3PB Barrister, Patrick Heneghan, and Partner at Morgan Lewis & Bockius, Sara Koleilat-Aranjo as they compare the US approach to witness preparation with witness familiarisation training, which is permitted in the UK. The panel will also discuss whether this situation creates an imbalance in international arbitration and whether a common cross-jurisdictional approach should be adopted.
